Montana Breastfeeding Law

 

Mothers in Montana have the right to breastfeed in any public location, as long as they are legally allowed to be there. Montana has limited workplace lactation accommodation legislation, but the federal FLSA’s PUMP Act now provides workplace lactation accommodation protections for all breastfeeding employees.

MT Breastfeeding Laws: At Work

All breastfeeding employees are now protected by the federal FLSA’s PUMP for Nursing Mothers Act that mandates reasonable break time and a private space (other than a bathroom) to pump at work for one year. In addition, Montana law requires all state and county governments, municipalities, school districts and the university system to give all breastfeeding employees break time to pump and a private space (not a bathroom) to pump at work.
